Terms of Service

Please read these terms carefully before using ExcitPay's services.

Welcome to ExcitPay! ExcitPay is a product of Local Home Coupons Private Limited (the "Company", "we", "us"). These Terms of Service ("Terms") govern your access to and use of ExcitPay's website, mobile application, and services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

IMPORTANT: These Terms contain an arbitration clause and class action waiver. Please read Section 11 carefully.

If you do not agree to these Terms, you may not access or use our Services.

1. Eligibility and Account Registration

1.1 Eligibility

You must be at least 18 years old to use our Services. By using ExcitPay, you represent and warrant that:

  • You are at least 18 years of age
  • You have the legal capacity to enter into binding contracts
  • You are not prohibited by law from using our Services
  • All information you provide is accurate and current

1.2 Account Registration

To access certain features, you must create an account. You agree to:

  • Provide accurate, complete, and current information
  • Maintain and update your information promptly
  • Keep your password secure and confidential
  • Accept responsibility for all activities under your account
  • Notify us immediately of unauthorized access

1.3 Account Suspension

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or misuse our Services.

2. Services Description

ExcitPay provides a platform for:

  • Table Booking: Reserve tables at partner restaurants
  • Pay at Restaurant: Pay your restaurant bill through ExcitPay
  • Dine-In Offers: Access exclusive restaurant offers (currently in Jaipur & Udaipur)
  • Rewards Program: Earn and redeem ExcitPay Wallet rewards

Important: ExcitPay acts as an intermediary between you and third-party service providers (restaurants and partner venues). We facilitate bookings but do not own or operate these services.

3. Bookings and Payments

3.1 Booking Process

When you make a booking through ExcitPay:

  • You enter into a contract directly with the service provider (the restaurant)
  • You agree to comply with the provider's terms, conditions, and policies
  • Prices displayed are subject to availability and may change until booking is confirmed
  • Confirmation does not guarantee service if the provider cannot fulfill the booking

3.2 Payment

  • All prices are displayed in Indian Rupees (INR) unless stated otherwise
  • You must provide valid payment information
  • Payment is processed through secure third-party payment gateways
  • You authorize us to charge your payment method for the total booking amount
  • Service fees and convenience charges may apply

3.3 Pricing and Availability

We strive for accurate pricing but errors may occur. If we discover a pricing error, we will notify you and give you the option to cancel or proceed at the correct price. We reserve the right to cancel bookings made with incorrect pricing.

4. Cancellations, Modifications, and Refunds

Cancellation, modification, and refund policies are governed by the specific service provider's terms and our Refund & Cancellation Policy. Please review these policies before booking.

  • Cancellation fees and refund eligibility vary by booking type
  • Some bookings may be non-refundable
  • Refunds may take 7-14 business days to process
  • Service fees and convenience charges may not be refundable

5. ExcitPay Wallet and Rewards

The ExcitPay Wallet rewards program allows you to earn and redeem store credit:

  • Store credit is earned on eligible bookings made through the ExcitPay app
  • Store credit has no cash value and cannot be transferred or sold
  • Store credit may expire after a certain period (check app for details)
  • We reserve the right to modify or discontinue the rewards program
  • Fraudulent activity may result in forfeiture of store credit and account termination
  • Redemption terms and conditions apply

6. Prohibited Conduct

You agree NOT to:

  • Use the Services for any illegal or unauthorized purpose
  • Violate any applicable laws, regulations, or third-party rights
  • Engage in fraudulent activity or provide false information
  • Interfere with or disrupt the Services or servers
  • Attempt to gain unauthorized access to any systems or data
  • Use automated tools (bots, scrapers) without permission
  • Impersonate any person or entity
  • Post harmful, offensive, or inappropriate content
  • Abuse or manipulate the rewards program

7. Intellectual Property

All content, features, and functionality of the Services, including but not limited to text, graphics, logos, images, software, and design, are owned by Local Home Coupons Private Limited (the company behind ExcitPay) or its licensors and are protected by intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our Services without our explicit written permission.

8. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We do not warrant that:

  • The Services will be uninterrupted, secure, or error-free
  • Information provided will be accurate or complete
  • Defects will be corrected
  • Third-party services will meet your expectations

Your use of the Services is at your sole risk. ExcitPay is not responsible for the actions, services, or products of third-party providers.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EXCITPAY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE.

Our total liability for any claim arising from your use of the Services shall not exceed the amount you paid to ExcitPay in the 12 months preceding the claim, or ₹1,000, whichever is greater.

10. Indemnification

You agree to indemnify, defend, and hold harmless ExcitPay, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including legal fees) arising from:

  • Your use of the Services
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your breach of applicable laws or regulations

11. Dispute Resolution and Governing Law

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

11.2 Jurisdiction

Any disputes arising from these Terms or your use of the Services shall be subject to the exclusive jurisdiction of the courts in Jaipur, Rajasthan, India.

11.3 Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms shall first be attempted to be resolved through good faith negotiation. If unresolved within 30 days, either party may initiate binding arbitration under the Arbitration and Conciliation Act, 1996.

12. General Provisions

Changes to Terms

We may modify these Terms at any time. Continued use of the Services after changes constitutes acceptance of the modified Terms.

Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full effect.

Entire Agreement

These Terms constitute the entire agreement between you and ExcitPay regarding the Services.

Waiver

Our failure to enforce any right or provision shall not constitute a waiver of that right or provision.

Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign our rights without restriction.
